School Board Found Negligent in Boca Raton School Bus Beating

FL Child Injury LawsuitA Palm Beach County jury has awarded $158,611 in damages to the family of a Boca Raton student who was taunted and beaten on a school bus in 2010.

After asking to see the school bus video of the beating one more time during its two-hour deliberation, the jury found the school board negligent and ordered it to pay the boy’s medical bills of $33,611, past pain and suffering damages of $75,000, and future pain and suffering of $50,000. Although state law caps the award at $100,000, the family was elated.

The family’s attorney told The South Florida Sun-Sentinel, “We’re happy the jury was able to render justice for [the boy].”

The plaintiffs claimed that the bus driver failed to keep the violence from escalating. According to the Sun-Sentinel, the video showed the boy being taunted by fellow students. The taunting then became physical as one student punched him three times in succession as other students watched.

The boy was diagnosed with a concussion and a fractured eye socket that needed emergency surgery for a muscle that was caught in the orbital bone.

The School Board’s attorney argued that the school bus driver had done his job to stem the rowdiness and that the boy was partially to blame because he had been “confrontational.” His mother said her son is autistic and “doesn’t like conflict.”

The student, who was in middle school when the beating took place, is now 16 and a junior in high school. His mother claims he still suffers from numbness in his face and occasional blurry vision – and now has an understandable fear of buses.
